Your privacy is important to us. This Privacy Policy describes how we may collect, use, and disclose information provided by you while using this website (the “Site”). Please take a moment to familiarize yourself with our privacy practices. We may amend this Privacy Policy from time to time by updating this page, so please check this page periodically to ensure that you are informed about any changes that we implement.  Your use of this platform constitutes your acceptance of, and agreement to, this Privacy Policy and the practices it describes.

COLLECTION AND USE OF PERSONAL INFORMATION

Personal information is data that can be used to uniquely identify or contact a single person. You may be asked to provide your personal information anytime you are in contact with us or our affiliates. We may share this personal information with our affiliates and use it consistent with this Privacy Policy.

The information we collect may vary depending on how you use our Site.  The personal information we collect may include your name, address, phone number, email address, , areas of interest, personal information contained in files you upload or in comments you submit to us, and other personally identifiable information about you.  Here are some examples of the types of personal information that we collect and how we may use it:

• When you purchase a product through the Site, we may collect your name, email address, mailing address, phone number, payment card information, and billing name and address.

• We may use your personal information to contact you with regard to your use of any of the Site and, in our discretion, changes to the any of the Site and/or any of the Site’s policies.

• The personal information that we collect allows us to keep you posted on our latest product announcements, promotions, special offers, and upcoming events. It also helps us improve our products, services, content, and advertising. If you do not want to be on our electronic mailing list, you can opt out any time. To do so, simply unsubscribe from emails via the unsubscribe link in each email you receive from us.

• From time to time, we may use your personal information to send important notices such as for transactional purposes. Because this information is important to your interaction with us, you may not opt out of receiving these communications.

• We may use personal information to improve the Site or create new service offerings, to customize your experience on any of the Site, or to serve you, or suggest to you, specific content that may be most relevant to you.

• We also may use personal information for internal purposes such as audits, data analysis, and research to improve our products, services, and customer communications.

• If you enter a sweepstake, contest, or similar promotion, we may use the information that you provide to administer those programs or otherwise as provided in the applicable rules.

• We may use your personal information to prevent unauthorized, improper or illegal activities on the Site.

• We may use your device location information to provide you location-relevant information such as on nearby locations that sell our products.

• We may use personal information for purposes disclosed at the time you provide your personal information or as otherwise set forth in this Privacy Policy or for any other legal purpose not inconsistent with this Privacy Policy or any written commitments made at the time of collection.

COLLECTION AND USE OF NON-PERSONAL INFORMATION

When you visit our Site, certain information about your visit is automatically logged.  Non-personal information, as the term is used in this Privacy Policy, is data in a form that does not permit direct association with any specific, identifiable individual.  We may use non-personal information for any purpose not inconsistent with applicable law, this Privacy Policy, or any written commitment we made at the time of collection. As is true of most websites, we may store or track usage information, such as user Internet Protocol (IP) addresses, browser type and language, Internet Service Provider (ISP), referring and exit pages, and date/time stamp, for any purpose, such as to better understand user behavior and facilitate the effectiveness of our content and advertising, all of which we will treat as non-personal information as permitted by applicable law.  We may also use aggregated usage and other information to provided information about our website to advertisers, potential business partners and other unaffiliated entities. In addition, as permitted by applicable law, personal information, including, without limitation, personal information, once “de-identified” (i.e., the removal or modification of personally identifiable elements or the extraction of non-personally identifiable elements, including through anonymization, psyudonymization and hashing) is non-personal information and may be used and shared without obligation to you, except as prohibited by applicable law.  However, we do not make assurances that de-identified data is not capable of re-identification. To the extent any non-personal information is combined by or on behalf of us with personal information we collect directly from you on the Site, we will treat the combined data as personal information under this Privacy Policy. We may also use information that we collect about you to provide advertisements or content to you, including based on your activities, and to understand the usefulness and effectiveness of the advertisements or content that have been delivered to you.

DISCLOSURE TO THIRD PARTIES

Without limiting the generality of the foregoing, at times, we may make certain personal information available to strategic partners that work with us to provide products and services, or that help us market to customers. For example, this may include affiliate service companies that help us with order processing, credit card processing, or data analysis.   We may share any information about you (including, without limitation, personal information) for any purposes not in-consistent with this Privacy Policy, or our statements as the point of collection, and not prohibited by applicable law.

The Site may include functionality that allows certain kinds of interactions between the Site and a third-party web site, platform, tool, application or other service, and accessing or display of third-party content via the Site (“Associated ThirdParty Services”).  The use of Associated ThirdParty Services may involve the third-party operator thereof (“ThirdParty Operator”) providing certain information, including personal information, to us.  For example, you may be able to access our Site via a third party platform, site, or other service, and those Third-Party Operators may collect personal information and other data about you in connection therewith, and may provide some or all of it to us (e.g., the third party may handle the billing of transactions for our products that are purchased via the Third Party Service and then tell us what you purchased so we can fulfill the order.

If we offer and you choose to use Associated Third-Party Services to access or use our Site, the Third-Party Operators may send personal information about you to us.  We will treat personal information Third-Party Operators provide to us consistent with this Privacy Policy.  If we discontinue use of any Third-Party Service, you consent that we may nevertheless retain any personal information, and other information and data, we may have already received in connection therewith in accordance with this Privacy Policy.

In addition, we may provide Associated Third-Party Services’ interfaces or links on the Site to facilitate your sending a communication from the Site.  For example, we may use third parties to facilitate e-mails, tweets, “likes,” content submissions or postings of comments on Facebook, Instagram, or other social media platforms.  We may also enable access to or display of third party content via the Site, that is actually being served or published by the third party, and such third party may be collecting data from you in connection with that content.  These third parties may collect and retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to our Privacy Policy. 

When you use Associated Third-Party Services, you are using their services and not our services and they, not we, are responsible for their practices.  You should review the applicable third-party privacy policies before using such Associated Third-Party Services in connection with our Site. 

We also may disclose any information that we possess about you (including your identity) if we determine that such disclosure is necessary for connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, or the rights or property of visitors to or users of the Site, including our customers. We reserve the right at all times to disclose any information that we deem necessary to comply with any applicable law, regulation, legal process or governmental request. We also may disclose your information when we determine that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes, or if we determine that disclosure is reasonably necessary to enforce any of our terms or policies or to protect us or other Site users. Additionally, in the event that we undergo a corporate reorganization, merger, or sale, we may transfer any and all personal information and non-personal information that we collect to any third party involved in such transaction.

PROTECTION OF PERSONAL INFORMATION

The transmission of information via the Internet is not completely secure, and we cannot guarantee the security of your information transmitted to our Site; any such transmission is at your own risk. We encourage you to always use caution when using the Internet. However, we take precautions – including administrative, technical, and physical measures – to safeguard your personal information against loss, theft, misuse, and unauthorized access, disclosure, alteration and destruction.

E-mail Security: “Phishing” is a scam designed to steal your personal information. If you receive an e-mail that looks like it is from us asking you for your personal information, do not respond. We will never request your credit card information via email.

COOKIES AND TRACKING TECHNOLOGIES

We use cookies and other now and hereafter known as tracking technologies (“Tracking Technologies”) for purposes such as to enhance your experience and track information about visitors and visits to our Site. Additionally, you may encounter cookies or other similar Tracking Technologies that are placed by third parties, such as advertisers, on pages that are linked to and from our Site. Cookies are small files that enable this Site’s or service provider’s systems to recognize your browser and carry certain information. GPS (global positioning systems) software, geo-filtering and other location-aware technologies locate (sometimes precisely) you for purposes such as verifying your location and delivering or restricting content based on your location. Our store finder feature may access and use information about your device location (such as based on IP address), or your account information, to suggest appropriate store locations.  Our Site content may be personalized based on various information we may have about you to try to provide you with more location-relevant content.

We may use cookies such as Google Analytics or cookies from other service providers for analytics services.  These analytics services may use cookies and other tracking technologies to help us analyze how users use the Site.  Information generated by these services (e.g., your IP address and other usage information) may be transmitted to and stored by Google Analytics and other service providers on servers in the U.S. (or elsewhere) and these service providers may use this information for purposes such as evaluating your use of the Site, compiling statistic reports on the Site’s activity, and providing other services relating to Site activity and other Internet usage. You may have certain choices regarding these activities as explained in the next section.

Customers may have the ability to have their personal computer warn them each time a cookie is set, or turn off cookies through their browser. Each browser is different, so look at your browser Help menu to learn the correct way to modify your cookies. We are not responsible for the effectiveness of your browser settings or tools. Turning cookies off may interfere with the normal functionality of the site.

Some information about your use of the Service and certain third-party services may be collected using Tracking Technologies across time and services and used by us and third parties for purposes such as to associate different devices you use, and deliver relevant and retargeted ads (“Interest-based Ads”) and/or other content to you on the Service and certain third-party services.  You may have certain choices regarding these activities as explained in the next section.

To modify your e-mail subscription, please unsubscribe from e-mails via the unsubscribe link in each e-mail.  Please note that your opt-out is limited to the e-mail address used and will not affect subsequent subscriptions.  If you opt-out of only certain communications, other subscriptions may continue.  Even if you opt out of receiving promotional communications, we may, subject to applicable law, continue to send you non-promotional communications, such as those about your transactions, servicing, or Power Crunch’s ongoing business relations.   

Tracking Technologies and Do Not Track Signals

You may exercise choices regarding the use of cookies from Google Analytics by going to https://tools.google.com/dlpage/gaoptout or downloading the Google Analytics Opt-out Browser Add-on. 

Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit.  Note, however, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser.  Some third parties, however, may also offer you choices regarding their Tracking Technologies. One way to potentially identify cookies on our Site is to add the free Ghostery plug-in to your browser (www.ghostery.com), which according to Ghostery will display for you traditional, browser-based cookies associated with the web sites you visit and privacy and opt-out policies and options of the parties operating those cookies. We are not responsible for the completeness or accuracy of this tool or third-party choice notices or mechanisms. 

Interest-Based Advertising

Certain companies we share your personal information with may participate in the Digital Advertising Alliance (“DAA“) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting.  You can learn more about the DAA AdChoices Program at http://www.youradchoices.com/. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). NAI has developed a tool that allows consumers to opt out of certain Interest-based Ads delivered by NAI members’ ad networks. To learn more about opting out of such targeted advertising or to use the NAI tool, see http://www.networkadvertising.org/choices/.  Please be aware that, even if you are able to opt out of certain kinds of Interest-based Ads, you will continue to receive non-targeted ads.  Further, opting out of one or more NAI or DAA members only means that those selected members should no longer under the DAA / NAI rules deliver certain targeted ads to you. This will affect this and other services, but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks).  Also, if your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different device or web browser(s), or use a non-browser-based method of access, your NAI / DAA browser-based opt-out may not, or may no longer, be effective.  Mobile device opt-outs will not affect browser-based Interest-based Ads even on the same device, and you must opt-out separately for each device. We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs.  However, we support the ad industry’s 2009 Self-regulatory Principles for Online Behavioral Advertising (https://www.iab.com/wp-content/uploads/2015/05/ven-principles-07-01-09.pdf) and expects that ad networks we directly engages to serve you Interest-based Ads will do so as well, though we cannot guaranty their compliance.

Our Site may contain links to other websites, including those of our partners or advertisers.  Please be aware that we are not responsible for the privacy practices or the contents of other websites. This Privacy Policy does not apply to the information practices of those other websites or platforms. We encourage you to read the privacy statements provided by other websites before you provide personally identifiable information to them.

YOUR CALIFORNIA PRIVACY RIGHTS

We may from time to time elect to share certain “personal information” (as defined by California’s “Shine The Light” law) about you with third parties for those third parties’ direct marketing purposes.  California Civil Code Section 1798.83 permits California residents who have supplied personal information, as defined in the statute, to us to, under certain circumstances, to request and obtain certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes.  If this applies, you may obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year (e.g. requests made in 2018 will receive information about 2017 sharing activities).  To make such a request, please provide sufficient information for us to determine if this applies to you, attest to the fact that you are a California resident and provide a current California address for our response.  You may make this request by contacting us via email at customerservice@powercrunch.com or in writing at:

Any such request must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code.  Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address or mail address.

OUR SITE AND CHILDREN

Our Site is meant for adults. We do not knowingly collect personally identifiable information from children under 13 without permission from a parent or guardian. We are a general audience service and do not use the Site to knowingly collect personal information from children under the age of thirteen (13) that requires parental notice and consent under the Children’s Online Privacy Protection Act (“COPPA”) without such parental consent.  If you are a child under thirteen (13) years of age, you are not permitted to use the Site and should not send any information about yourself to us through the Site. 

In the event that we become aware that we have collected personal information from any child, we will dispose of that information, or otherwise treat it, in accordance with COPPA and other applicable laws and regulations.
